The Dhaka Times Desk The Appellate Division has directed the Bangladesh Telecommunication Regulatory Commission to immediately resume the closed wave and network operations of the country's first private mobile phone operator CityCell.
The court asked Citycell to deposit Rs 100 crore in favor of BTRC by November 19. This way if they fail then their wave can be turned off again.
Today (Thursday) a 4-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha gave this order.
The Appellate Division has constituted a special committee under the leadership of Professor Jamilur Reza Chowdhury to resolve the dispute over Citycell's outstanding amount. The dispute has been asked to be resolved within the next 30 days.
It is to be noted that the Bangladesh Telecommunication Regulatory Commission (BTRC) canceled the airwave allocation and stopped the operation of Citycell on October 20 due to non-payment of dues.
Meanwhile, CityCell applied on October 24 asking for the decision of BTRC to be postponed or for re-allocation of waves. The chamber judge sent the matter to the regular bench of the Appellate Division for hearing on October 31. After taking the hearing, the Appellate Division gave the order today.
Lawyer Rokon Uddin Mahmud was on behalf of Citycell. AM Aminuddin and Mostafizur Rahman Khan were with him.
On the other hand, Attorney General Mahbubey Alam, Sheikh Fazle Noor Tapas and Khandaker Reza-e Rabi were on behalf of BTRC.
Citycell's lawyer Mostafizur Rahman Khan told the media that BTRC has been instructed so that Citycell can start its operations today. The wave allocation already canceled by BTRC has been withdrawn. That's why there are no legal obstacles for CityCell to operate.
