On the question of extending the jurisdiction of the BSF, Tapas Roy, an important leader and MLA of the state, accused the BSF of border killings, disappearances, abductions with statistics. The assembly was heated about that on Wednesday. Leader of Opposition in the state Subvendu Adhikari also took a swipe at the West Bengal government's stance.
The state government passed a resolution in the assembly on Tuesday. The motion, which passed by a vote of 112-63, opposes the Center's decision. The Center said the jurisdiction of the BSF will be extended to states like West Bengal and Punjab. They can work in the area up to 50 km from the border. In that area, they can search and arrest ordinary people's houses. They can do this without police permission.
The complaint of the state is that this decision of the Center is completely against the federal structure. Thus the Center is basically trying to interfere in the jurisdiction of the states. A key state minister and Trinamool secretary general Partha Chatterjee told the assembly that the 'Centre is trying to capture state territory through the back door.' According to him, despite the jurisdiction that BSF had earlier, they could not stop border crimes. Now on what grounds can they stop crime in the new jurisdiction?
Tapas Roy also raised several facts against BSF in the assembly. His statement is, 'There are 240 cases of torture, 60 murders and 8 cases of disappearance against BSF in the last 5 years. The BJP wants to take over one-third of the state by expanding the jurisdiction of that BSF and we will see it through?'
In response to this accusation of Tapas, BJP leader Subvendu Adhikari also attacked. In the Assembly, he said, 'We can sleep soundly at night because they guard the border, vulgar, vulgar language is used in the Assembly in their name.' Another BJP MLA Srirupa Mitra Chowdhury said that 'BSF can only arrest or seize. They have no powers of investigation or prosecution. They have no conflict with the police. So where is the difficulty?'
Human rights activists think that there are many difficulties. Kiriti Roy, an official at the human rights organization Masum, said, “Border killings are an important issue. Increasing the BSF's power would mean more unrest on the border. On what logic is the Border Security Force required within 50 km of the border?”
MLA Udayan Guha, who recently won from Dinhata in the by-election, said that BSF is also involved in border smuggling. They showed cards and searched the women who came to work across the barbed wire. The argument to extend the jurisdiction of BSF is not tenable at all. This will increase the unrest. In fact, the Left and the Congress have also opposed the Centre's decision.
The West Bengal Legislative Assembly also passed a resolution opposing the central decision to extend the jurisdiction of the BSF. Earlier, the Punjab Legislative Assembly had also done the same. But what will be the benefit? A former BSF officer, who did not want to be named, said that the responsibility of border security is mainly with the Centre. That is why this proposal of the assembly cannot change the law. But can create pressure on central policy. On Wednesday itself, the BSF has been told that they will work only after talking to the local police. Their powers were not actually increased. Now it remains to be seen whether the Center changes its decision in the face of pressure from two important border regions like Punjab and West Bengal.
